Terms of Use

1.0 Introduction

Welcome to CenuKa, a mobile application that provides online loan services to eligible users in Uganda. These Terms of Use ("Terms") establish the rights and obligations between you and us when you use our mobile application and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to any of the terms of these Terms, you may not access or use our Services.

2.0 Definitions

2.1 "CenuKa" refers to the mobile loan application and its operating company.

2.2 "User" refers to any individual who accesses or uses the CenuKa application or Services.

2.3 "Account" refers to the account created by the User on CenuKa to access the Services.

2.4 "Loan" refers to the credit agreement between CenuKa and the User, whereby CenuKa provides funds to the User, and the User agrees to repay the funds with interest according to the agreed terms.

2.5 "Device" refers to the smartphone or other electronic device used to access the CenuKa application.

2.6 "Interest Rate" refers to the rate applicable to the Loan, as specified in the individual Loan Agreement.

3.0 Scope of Services

3.1 CenuKa offers mobile loan services to eligible users in Uganda, including:

  • Credit risk assessment
  • Loan approval and disbursement
  • Loan account management
  • Payment processing
  • Repayment reminders

3.2 CenuKa reserves the right to modify, suspend or terminate any of the Services at any time without prior notice.

4.0 Account Registration and Management

4.1 To use the Services, you must create an account on CenuKa. When registering, you agree to provide true, accurate and complete information.

4.2 To create an account, you must:

  • Be at least 18 years old
  • Reside in Uganda
  • Have a valid mobile phone number and a compatible Device
  • Have a valid national identification card

4.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.4 CenuKa may verify the information provided during registration and may refuse to create an account if the information is false, incomplete or inaccurate.

4.5 You may close your account at any time by contacting us. CenuKa may also suspend or close your account if you violate these Terms.

5.0 Loan Request and Approval

5.1 To request a Loan, you must:

  • Have an active account on CenuKa
  • Provide additional information necessary for credit assessment
  • Accept the specific terms of the Loan

5.2 CenuKa will evaluate your loan eligibility based on various factors, including:

  • Identity verification information
  • Credit history
  • Financial and employment information
  • Emergency contact information
  • Risk analysis based on Device data

5.3 CenuKa reserves the right to approve or reject loan applications at its sole discretion, without providing reasons.

5.4 If your request is approved, you will receive a Loan Agreement with specific terms, including the loan amount, interest rate, repayment period and due date.

5.5 Acceptance of the Loan Agreement indicates your agreement to comply with all specified obligations, including full payment by the agreed-upon deadline.

6.0 Loan Disbursement

6.1 The approved loan funds will be deposited into the bank account or mobile wallet account you selected during the application process.

6.2 CenuKa will make every effort to process the loan disbursement as quickly as possible, but does not guarantee exact transfer times, as this may depend on third parties (such as financial institutions).

6.3 You are responsible for providing accurate and complete bank or mobile wallet information. CenuKa is not responsible for disbursement failures due to incorrect information provided by you.

7.0 Loan Terms and Repayment

7.1 The total payment amount includes the loan principal and applicable interest.

7.2 Payments must be made before the due date specified in the Loan Agreement.

7.3 Accepted Payment Methods:

  • Mobile money (MTN Mobile Money, Airtel Money)
  • USSD Payment

7.4 Late payments may result in:

  • Additional late fees
  • Notification to credit bureaus
  • Service interruption
  • Legal action to recover the amount due

7.5 You may repay the Loan at any time without penalty.

8.0 User Rights and Obligations

8.1 User Rights:

  • Access and use the Services in accordance with these Terms
  • Receive clear information about loan terms
  • Receive repayment reminders
  • Contact CenuKa support for assistance

8.2 User Obligations:

  • Provide true, accurate and complete information
  • Keep account credentials confidential
  • Comply with the terms of the Loan Agreement
  • Pay all amounts due by the agreed deadlines
  • Use the Services only for legal purposes
  • Not interfere with the operation of the Services
  • Not use the Services for fraudulent activities

9.0 CenuKa Rights and Obligations

9.1 CenuKa Rights:

  • Verify information provided by Users
  • Approve or reject loan applications at its sole discretion
  • Modify, suspend or terminate the Services
  • Charge interest and late fees as specified
  • Suspend or close accounts for violation of these Terms

9.2 CenuKa Obligations:

  • Provide the Services in accordance with these Terms
  • Maintain the security of User information
  • Process loan applications fairly and transparently
  • Provide customer support
  • Comply with applicable laws and regulations

10.0 Intellectual Property

10.1 All intellectual property rights related to the CenuKa application and Services, including trademarks, logos, trade names, software, content and design, are the exclusive property of CenuKa.

10.2 You may not copy, modify, distribute, sell or rent any part of the Services without the express written authorization of CenuKa.

11.0 Limitation of Liability

11.1 CenuKa is not responsible for any direct, indirect, incidental, special or consequential damages arising from the use or inability to use the Services.

11.2 CenuKa does not guarantee that the Services will be available at all times, uninterrupted or error-free.

11.3 CenuKa is not responsible for Service performance failures due to factors beyond its control, including network problems, third-party hardware or software failures.

12.0 Privacy

12.1 CenuKa collects, uses and protects Users' personal information in accordance with our Privacy Policy, which is an integral part of these Terms.

13.0 Modifications to the Terms

13.1 CenuKa may update these Terms from time to time to reflect changes in our practices, technologies or legal requirements.

13.2 When we make significant changes, we will notify you by publishing the updated Terms in our application and, if necessary, through other communication channels.

13.3 Your continued use of our Services after the changes take effect constitutes your acceptance of the updated Terms.

14.0 Dispute Resolution

14.1 Any dispute arising out of or relating to these Terms or the Services should be resolved through amicable negotiation.

14.2 If the dispute cannot be resolved through negotiation, it should be submitted to the competent Ugandan courts.

15.0 Applicable Law

15.1 These Terms are governed and interpreted in accordance with the laws of Uganda.
